Terms of Service

These Terms of Service govern your use of PinPiner. They cover who may hold an account, what you may post, the rights you keep and the licence you grant, how copyright complaints are handled, and how disputes between us are resolved. Read section 12 carefully: it contains an arbitration agreement and a class action waiver.
1. Agreement to these terms
PinPiner is operated by PICH RATHA, doing business as PinPiner (“PinPiner”, “we”, “us”). By creating an account or using the service you accept these terms. If you do not accept them, do not use PinPiner.
These terms work alongside our Privacy Policy, which explains what we collect and why. Where the two documents describe the same subject, the Privacy Policy governs how information is handled.
2. Who may use PinPiner
You must be at least 14 years old. PinPiner is a general-audience service, is not directed to children under 13, and does not knowingly allow them to hold an account. If we learn that an account belongs to a child under 13 we will restrict it and delete the child’s personal information, as the Children’s Online Privacy Protection Act requires.
If the law where you live sets a higher minimum age to use an online service or to consent to the processing of your own data — 16 in parts of the European Economic Area and the United Kingdom — you must meet that higher age, or hold whatever parent or guardian authorisation your local law requires.
If you are under 18, you may use PinPiner only with the involvement of a parent or legal guardian who accepts these terms on your behalf. You may not use PinPiner if you are barred from doing so under applicable law, including United States sanctions and export controls.
3. Your account
Signing up asks for an email address, a password, your date of birth — which we use to confirm you meet the minimum age in section 2 — and your gender. You may instead sign up with Google or Facebook, in which case we receive your email address and name from that provider and ask you for the date of birth and gender before the account is created.
Give us accurate information and keep it current. Keep your password to yourself: you are responsible for activity under your account. Tell us at [email protected] immediately if you believe someone else has gained access to it. Never send a password, verification code, or other secret through a post, comment, or message on PinPiner.
4. Your content and the licence you grant
You keep ownership of everything you upload. You grant PinPiner a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt for technical purposes such as transcoding and thumbnail generation, publish, and display your content in order to operate, promote, and improve the service, including in feeds, search results, and recommendations.
That licence ends when you delete the content or close your account, except for copies held in backups until they age out of normal rotation, copies we must retain to comply with law or to document a moderation action, and any copy another person lawfully saved or reshared while the content was public.
You confirm that you own or have permission to distribute everything you upload, and that it does not infringe anyone else’s rights.
5. Rules of conduct
You may not post, upload, or share:
- Content you do not have the rights to share, including anything that infringes a copyright, trademark, or other right.
- Any sexual content involving a minor, or content that sexualises a minor in any way. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children as United States law requires.
- Threats, harassment, stalking, or incitement to violence against any person or group.
- Content that promotes self-harm or suicide, or that gives instructions for making weapons, explosives, or illegal drugs.
- Impersonation of another person, business, or organisation, including synthetic media presented as genuine.
- Non-consensual intimate imagery, or private information about someone published without their consent.
- Spam, deceptive schemes, fraud, or the sale or transfer of PinPiner accounts.
- Malware, or attempts to probe, scrape, overload, or gain unauthorised access to the service or to manipulate Stars balances or engagement counts.
We may remove content, limit its distribution, or suspend or close an account that breaks these rules. Where we can, we will tell you what happened and how to appeal.
6. Copyright — DMCA notice and takedown
PinPiner responds to notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512. To submit a notice, send our designated agent a written communication that includes:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material you say is infringing, with enough detail for us to find it — a link is best.
- Your address, telephone number, and email address.
- A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

If your content was removed and you believe that was a mistake or a misidentification, you may send a counter-notice containing the elements set out in 17 U.S.C. § 512(g)(3). Anyone who knowingly misrepresents that material is infringing, or was removed by mistake, may be liable for damages under 17 U.S.C. § 512(f). We terminate the accounts of repeat infringers in appropriate circumstances.
7. Stars and creator support
Stars are a virtual in-service unit used to support creators and unlock media. They are not money, not a bank deposit, not insured by the FDIC or any equivalent scheme, and earn no interest. They have no cash value outside PinPiner and cannot be redeemed for cash except where the law requires it. PinPiner does not currently process real-money purchases through the service.
Stars activity is recorded in an auditable ledger. If a transfer was made in error, or a creator failed to deliver what they promised, contact [email protected] and we will look at it. Creators are responsible for any tax due on what they receive.
8. Suspension and termination
You may stop using PinPiner and close your account at any time. We may suspend or close an account that breaks these terms, that we must act on by law, or that puts other people or the service at risk. Where we can, we will explain why and how to appeal. Sections 4, 9, 10, 11, and 12 survive the end of this agreement.
9. Disclaimers
To the fullest extent permitted by law, PinPiner is provided “as is” and “as available”, without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or free of errors, or that content posted by other people is accurate, lawful, or suitable.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, neither PinPiner nor its owner, officers, employees, or agents will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the service.
Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred United States dollars. Nothing here limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence.
11. Indemnification
You agree to indemnify and hold PinPiner harmless from any claim, loss, or expense — including reasonable legal fees — arising from content you post, your use of the service, or your breach of these terms or of anyone else’s rights.
12. Disputes, arbitration, and governing law
Talk to us first. Before starting a formal proceeding, write to [email protected] describing the problem and what you want. If we cannot resolve it within 60 days, the following applies.
Arbitration. If you live in the United States, you and PinPiner agree that any dispute arising out of or relating to these terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. Either of us may still bring an individual claim in small claims court, and either of us may seek injunctive relief for infringement or misuse of intellectual property.
No class actions. Disputes must be brought individually. Neither of us may act as a class representative or take part in a class, consolidated, or representative proceeding.
Opting out of arbitration. You may reject the arbitration agreement and the class action waiver by emailing [email protected] within 30 days of first accepting these terms, stating your username and that you opt out. Opting out affects nothing else in these terms.
Governing law and venue. These terms are governed by the laws of the State of Indiana and the federal laws of the United States, without regard to conflict-of-laws rules. Where a claim is not subject to arbitration, you and PinPiner submit to the state and federal courts located in Indiana.
If you live in the European Economic Area or the United Kingdom, nothing in this section removes the protection of the mandatory consumer law of the country where you live, or your right to bring proceedings in your local courts.
13. Changes to these terms
We may update these terms as PinPiner changes or the law requires. If a change is material we will give notice in the service or by email at least 30 days before it takes effect, unless it must take effect sooner for legal or security reasons. The date at the top of this page always shows the current version. Continuing to use PinPiner after a change takes effect means you accept it.
